Question of the Week

What happens to a sc 485 temporary graduate visa application when the student takes a trimester off?

Category: Student Visa

Question asked

I am just about to finish my graduate certificate in accounting and next month I will continue with masters of professional accounting which ends 17/10/2020 (coe and visa attached). I would like to take more subjects this coming trimester in order to have one trimester off between March-June or even shorten my study by cutting the last trimester next year July-October but I am worried if I will satisfy conditions for temporary graduate visa doing this which requires two years full time study.

After completion of these two courses am I eligible for temporary graduate visa at all and how would taking a trimester off (March-June) or additionally shortening (July-October trimester) study affect application for 485 temporary graduate visa? The school is willing to write letter confirming holidays for the whole trimester if I take more subjects through other two trimesters. VEVO also mentiones that gap shouldnt be longer than 2 months?

Answer provided by Migration Agent

If you are planning to have one trimester off (ie; March-June 2020), then you will need permission from your institution whether they can allow you to do that or not. If they allow you then that is fine. If they don’t then you will need to abide by your visa conditions.

If you plan to shorten your study or finish your study before your visa finishes, (ie; finished before attending July-Oct 2020 trimester) then you have 28 days to either leave Australia or apply for another visa.

One of the requirements for someone applying to 485 visa is that the course they completed must have taken at least 92 weeks of study and must have taken place over at least 16 months. If you fulfil this criterion (ie; divided your courses as such that you meet the above requirement) along with all the requirements, then you can still apply for subclass 485 visa.
