Question of the Week

Can I change a prospective marriage visa to a de facto visa?

Category: Partner Visa

Question asked

Hi,
If I have applied for a prospective marriage visa, am I able to change it to a de facto visa before or after it is finalized?

H.

Answer provided by Migration Agent

Hi H.

In general, a de facto visa is when you are in relationship for at least 1 year and not married. In case your relationship is more than 1 year old and you got enough evidences for that, you can withdraw your prospective marriage visa and apply for de facto . Please note in this case, visa application charge is non-refundable. There is form available to withdraw your application or it can be done online.
