Question of the Week

Transferring from a Working Holiday Visa to a Student Visa without having to leave the country?

Category: Student Visa

Question asked

Hello,

I am currently on a Working Holiday Visa (417) and am planning on applying for a student visa. My course date begins February 15 2021, and the orientation date is January 28 2021. My current WHV expires on October 16, 2021. It's my understanding of the student visa that you can arrive 90 days before your course starts. However, if there are a few weeks between my WHV expiring, and those 90 days starting, will I be denied the student visa? I cannot leave the country and re-enter as the borders are closed. Should I try to find a course that starts earlier?

Thanks
T.

Answer provided by Migration Agent

Dear T.,

The department policy says:
If a visa applicant seeks to make an application more than four months before the course commencement date, they will receive a warning in ImmiAccount. The warning alerts them that Home Affairs might not prioritize their visa application and they may wish to apply closer to the course commencement date, no more than three months prior to course commencement.

It means your application will not be prioritized for the process.

You don't need to go overseas. You can lodge your student visa application before your current visa expiry. As soon as your current visa expires, you will receive BVA.

Your application will be assessed as normal, depending upon the country of your passport. You need to meet the criteria of Genuine Temporary Entrant. Please ensure, you don't need to go anywhere, you are legal and safe.

Feel free to contact us, if you need assistance with student visa application or CoE.
