Question of the Week

The problem with 30 years waiting time until visa grant, Covid-19 and what to do when travelling overseas.

Category: Visa for Australia

Question asked

My mom applied for on Onshore Aged Parent Visa few years ago and then she got a bridging visa B to visit her birth country. On that visa she left Australia early February 2020 and her BVB is due to expire in March 2021.

One of the conditions on her BVB is 'Must not arrive after 15 March 2021'. She applied for a travel exemption to come back to Australia, but it was rejected. Under this situation if she doesn't come back by the above date her BVB will expire.

Will this have an impact on her Parent Visa application?

And what options or what visa does she has to apply to come back to Australia and continue with her parent visa application after the travel restrictions are lifted?

Answer provided by Migration Agent

Dear K.

If your mother is not able to enter Australia before the expiry of her bridging visa B, when the restrictions are lifted, she will have to enter on another visa (e.g. visitor visa) and once onshore she can apply to have her bridging visa reinstated.

There will be no impact on her parent visa application.

-------- Clarification Request --------------

Thank you for that.

If she can get a visitor visa to come back, how can we get her bridging visa reinstated so she can indefinitely stay in Australia until her parent visa is granted? do we have to apply for another visa while onshore? if so what visa? If not another visa how or where do we put that request through? Thanks.

--------- Response by Migration Agent ---------

Once onshore, she can lodge the request for the bridging visa via the Immiaccount or via Form 1005.

No need to apply for another visa when onshore (a part from the bridging visa as per above)
