Question of the Week

After 6 years in Australia, a UK citizen is seeking Permanent Residence.

Category: Visa for Australia

Question asked

Hello

I am a UK citizen and have been in Australia for about 6 years.

I am an experienced Recruitment Consultant, with many years of experience in this occupation. I don't have any formal qualifications though. I came on 485 visa as secondary applicant. My relationship ended few years ago.

I have been working as a Recruitment Consultant for a very big firm in Sydney, for a number of years. The firm has been operating for a long time, at least 10 years, Last year their turnover was $12 million.

I am currently on a Temporary Skill Shortage (subclass 482) visa.

My visa history is:

- While holding a subclass 485 visa (expiring on 18 December 2019), I applied for a subclass 482 visa on 10 December 2019

- Bridging A visa was granted

- 482 visa was approved on 26 February 2020, valid for 2 years until 26 February 2022

- Second 482 visa applied for on 15 February 2022

- Bridging A visa was granted again

- The second 482 visa was granted on 25 May 2022, valid for 2 years until 25 May 2024

I wanted to inquire about my possible visa options now. I am looking to get a permanent visa if possible. I did some research and understand that I can't apply for 189, 491 and 190 visa because I can't obtain a skills assessment because of no formal qualification in relation to my field. I am looking for permanent visa if possible, is there any option for me?

Answer provided by Migration Agent

Hello S.

Recruitment consultant is on the STSOL list and you may be able to apply for permanent residence through the Temporary Residence Transition (TRT) stream of the Subclass 186 Employer Nomination Scheme (ENS) visa since you were in Australia between 1 February 2020 and 14 December 2021 for at least one year.

Read more about Permanent Residence in Australia.

I do not know If you meet the other requirements (can be discussed in a further consultation if you wish) but I would suggest you explore this visa as a possibility as the skills assessment only “may be asked” for and thought I should mention it as i did not see it on your list.

In regards to your question regarding skills assessments – the relevant body for you will be VETASSES. You mentioned you have no formal education in the area but do you have degree or higher in any subject? – a combination of educational qualifications in a non related field and a certain number of years experience in the profession can be combined for a skills assessment.

I will attach a PDF from VETASSES that will explain the requirements.

Feel free to contact me for any clarifications.
