Question of the Week

What is the difference between work experience and part time work on a subclass 494 visa (Skilled Employer Sponsored Regional (Provisional) visa)?

Category: Visa for Australia

Question asked

I have a question about the subclass 494 visa (Skilled Employer Sponsored Regional (Provisional) visa).

Among the visa criteria is the following: “You must have been employed full time in the proposed occupation for at least 3 years and have the required level of qualifications for the proposed occupation.”

In general, you should have gained your work experience within the last 5 years. The period does not have to be continuous. We could consider an equivalent part time job. Casual work is out of the question for us.”

I worked full time as a draftsman and BSc Arch from September 1st, 2015 to August 31st, 2021 (40hours a week). I have been working part time (30 hours a week) since September 1st, 2021.

Can you let me know if I meet the work experience for the visa application or how I can still do it (suggestions, tips)?

I thank you very much in advance.

Yours faithfully,

M.

Hi M.,

Thank you for your question.

Your work experience is enough for the purpose of subclass 494 visa application.

Thank you for your quick response.

Would it be possible for you to explain my situation in more detail how the working hours are added

up to make it fit for the visa application (Visa Subclass 494)? With a possible explanation I could then

understand my question better. This is of the utmost importance to me as I will likely be working part

time (due to family reasons) for another 6 months or maybe longer before I can apply for a visa.

Otherwise I will be forced to adjust my work situation immediately.

Thank you again in advance.

---------  Clarification from Migration Agent  --------------

Dear M.,

Sure, here's a more detailed explanation.

According to the visa criteria, you must have been employed full-time in the proposed occupation for at least 3 years and have the required level of qualifications for the proposed occupation. The period does not have to be continuous, and you can meet the full-time requirement with equivalent part-time work. However, casual work is not considered.

The 5-year proceeding to today is 06/09/2018. In your case, you worked full-time as a draftsman from September 1st, 2015 to August 31st, 2021 (40 hours a week) which If counted from 6/9/2018 is 3 years to 31/8/202. This meets the full-time requirement for the visa. You have also been working part-time as a draftsman since September 1st, 2021 (30 hours a week). This can be considered equivalent to part-time work, this will be considered as 1 year of full-time work. So you would meet the full-time requirement for the visa as you have 4 years of full-time experience in the last 5 years.

Please let me know if you have any further questions.
