My girlfriend is New Zealand citizen living in Australia for 2 years.



We met 6 months ago and I live in England.



Is it possible to get a partner visa? How long will it take?

Dear C.

Thank you for reaching out. For you to be eligible for an Australian partner, your girlfriend would need to be an "eligible New Zealand citizen". In general, this means that she must have been in Australia on or before 26 February 2001.

Additionally, as you are not married, the law requires that you must have been in a committed and exclusive relationship for a minimum of 12 months. Normally this also requires a period of cohabitation, unless you can provide a compelling reason why this was not possible.



From the information you have provided, it would seem that you may not be eligible. Can you confirm when was the first date your girlfriend arrived in Australia, or whether she may also hold Australian citizenship or an Australian permanent visa? There may be some ways to overcome the 12 months' relationship limitation however she would need to be an Australian resident in order to act as your sponsor.

My girlfriend only first came to Australia 3 years ago, and she doesn't have any Australian citizenship. She just got one of those New Zealand citizenship visa on arrivals when she first got to Australia. Are there any ways for me to get an Australian partner visa then? I am not interested in any student or work visas.

It sounds like she holds what is known as a 444 Special Category Visa. As her partner, you may be eligible for a 461 New Zealand Citizen Family Relationship visa. You would need to show that you are in a genuine committed relationship to the exclusion of all others, amongst other things.
