A parent on a sc 600 visa is seeking to extend her stay in Australia. A “no further stay” condition and the solution to the problem.

My mom is a 65 year old from Canada currently here on a 600 tourist visa visiting me and my family. Her current 600 visa expires in February 2023 but she would like to extend her visit in Australia .

She was in Australia from Feb 2022 - Jul 2022 initially on an ETA which was then changed to a 600 visa. She returned to Canada for 3 months and has been back in Australia now since 2 Nov 2022. She would like to remain in Australia until April 2023 and then will return to Canada.

What are her options?

If she leaves Australia to go to New Zealand or Fiji for a short holiday, can she apply for an ETA while outside of Australia and then re-enter the country?

Dear S.,



You mum’s ability to lodge a further visa to continue her stay in Australia will be dependent on whether she has a “no further stay” condition imposed on her current visitor visa. If a “no further stay” condition has been imposed, she will not be able to apply for a further visa whilst onshore in Australia. This will mean that she will need to travel offshore to apply for another ETA to return to Australia or she will be required to apply for a waiver of the “no further stay” condition to enable her to lodge a valid visa application onshore.



If a “no further stay” condition has not been imposed, your mum will be permitted to lodge a further visitor visa onshore to extend her period of stay. The criteria will be the same as her previous visitor visa application. She must submit her visa application before her current visa expires. Once an application is lodged onshore, your mum will be granted a Bridging visa A, which will permit her to remain legally in Australia until a decision is made on her visa application.



The visa application charge for an onshore visitor visa is $380.00. The cost of a return flight to apply for an ETA offshore may exceed an onshore application. This may play a role in your decision of whether to lodge her visa offshore or onshore.
